Michigan Justices Parse Laws on Where Attorney General Can Sue

Michigan’s justices on Wednesday grappled with who should have home-court advantage when the state attorney general brings certain lawsuits.

The state Supreme Court didn’t clearly indicate their leanings in a dispute over where a suit by Attorney General Dana Nessel (D) to recover more than $500,000 in ill-gotten Michigan Medicaid money must be heard. However, multiple justices said they struggled with convicted pharmacist Raad Kouza’s arguments that an “injury” happened not where the state agency at issue is located, but rather in the place where the wrongdoing occurred.
