Michigan Corrections Officials Beat Officer’s Due Process Appeal

A Michigan corrections officer was too late with his lawsuit alleging he denial of due process over his firing for purported workplace harassment, the Sixth Circuit ruled.

The time to sue for procedural due process is measured from when the deprivation of a constitutionally protected property interest occurred and fair and adequate review was denied, the court said. The Michigan Department of Corrections formally terminated Charles Bozzo on July 31, 2019, and Dec. 17, 2020—when Bozzo’s post-termination arbitration ended—was “the latest possible date” for when he allegedly was denied due process.
