Michigan Clean Energy Project Rules Mostly Blessed by Court

Michigan appeals court judges mostly gave their blessing to rules enacted by state energy regulators to implement a Democrat-backed law limiting local government’s power to approve clean energy projects, though they took issue with a couple legal interpretations.

With two exceptions, the Michigan Public Service Commission “did not otherwise err in its interpretations” of the law, the three-judge state Court of Appeals panel said Thursday. The commission also didn’t run afoul of the state Administrative Procedures Act as it enacted the rules, Judge Christopher M. Murray wrote for the three-judge panel.
