Michael Cohen is asking the US Supreme Court to revive a lawsuit against Donald Trump alleging he and others conspired to use the federal prison system to silence Cohen’s vociferous criticism of his former boss.
The US Court of Appeals for the Second Circuit affirmed dismissal of the lawsuit in January, saying it couldn’t recognize a claim for damages, as Cohen had and successfully pursued “alternative forms of judicial relief.” The appeals court had also noted “significant separation-of-powers concerns,” given the defendants named in the lawsuit.
