Mexico can pursue negligence claims against five Arizona firearms dealers, but the country’s public nuisance and Racketeer Influenced and Corrupt Organizations Act allegations fall short, a federal judge said Monday.
Mexico has constitutional standing to sue and adequately alleged unjust enrichment and multiple variations of negligence, the US District Court for the District of Arizona said. However, the country can’t pursue its fraudulent advertising, public nuisance, and RICO claims, the opinion said, dismissing those portions of the suit.
