MeUndies Inc. sued Saxx US Acquisition Inc., its Canadian rival, seeking a declaration that its men’s underwear with a trademarked “Ball Caddy Pouch” doesn’t rip off a Saxx patent.
The suit, filed in the US District Court for the Central District of California, preempts a potential patent infringement action by Saxx over US Patent No. 7,958,571, which describes underwear with a “pear shaped” “genital pouch” designed to cut down on “irritation due to skin-to-skin friction” and chafing.
