MetaBirkin NFT Artist Appeals After Hermès Trademark Case Loss

An artist who sold NFTs depicting Birkin handbags appealed to the Second Circuit after a New York federal jury concluded the tokens violated Hermès International SA’s trademark.

Mason Rothschild, the man behind the “MetaBirkins” non-fungible token, notified the US District Court for the Southern District of New York on July 21 that he would appeal the outcome of the first ever NFT trademark case to go to trial.

Rothschild previously asked the court for a new trial, but was denied. Judge Jed S. Rakoff also granted Hermès’ request for a permanent injunction to stop the defendant from selling more NFTs ...
