Mesa Air Group Faces Revived Arab Bias Suit for Canceled Flight

Two Muslim airplane passengers got their racial discrimination suit against Mesa Air Group Inc. revived, in a case that raised novel questions for the Fifth Circuit.

Just because everyone on the Birmingham-Dallas flight experienced the negative consequence of an airline’s allegedly discriminatory decision doesn’t mean the targets of said discrimination are barred from alleging a civil rights claim, the US Court of Appeals for the Fifth Circuit ruled Wednesday. Mesa operated the flight for American Airlines.
