Merz Pharmaceuticals LLC is entitled to a preliminary injunction barring a former employee from disclosing trade secrets because it’s likely to succeed on its claim that he violated a confidentiality agreement, a North Carolina trial court ruled.
Merz alleges that Andrew Thomas downloaded over 500 files from his work computer onto a thumb drive on the day of his termination and that the documents contained confidential information and trade secrets. Thomas later testified that he permanently deleted all of the contents on the thumb drive.
