Merck Unit Faces Online Privacy Case That Tests New Legal Theory

HomeAgain, a Merck & Co. division, is facing a lawsuit that tests a new legal theory, stretching a California law against “pen register” software amid a flood of interest in online tracking tool litigation.

The pharmaceutical giant’s pet service provider, Intervet Inc., which does business as HomeAgain, allegedly uses pen register software, which links IP addresses to particular people in order to identify anonymous website visitors in great detail, according to the proposed class action complaint filed Friday in Los Angeles County Superior Court. The technology can reveal a details as personal as voter registration status and working hours.
