Mentavi Defeats Wiretap Claim in Suit Over Meta Data Disclosure

Mentavi Inc. escaped a federal wiretapping claim in a proposed class action alleging the online mental-health treatment provider illegally intercepted and disclosed patients’ communications without their consent.

The plaintiffs failed to show that Mentavi acquired their communications for the purpose of committing a crime or tort, a requirement for establishing liability under the Electronic Communications Privacy Act for a party to a communication, the US District Court for the Western District of Michigan said Thursday.
