Menards Must Keep Facing Rebate Voucher Deception Claims

Menard Inc. must keep defending claims that it duped consumers about its rebate program, as a Wisconsin federal court said plaintiffs’ allegations that the home improvement chain’s ads “factored into” their purchasing decisions were sufficient to show a link to the alleged deception.

And the would-be class plaintiffs raised plausible consumer protection claims, Judge James D. Peterson of the U.S. District Court for the Western District of Wisconsin said Dec. 11.

Plaintiffs in Wisconsin, Illinois, Michigan, and North Dakota alleged Menards promised “11% Off Everything” in a mail-in rebate promotion that promised vouchers for future purchases. But the company either ...
