Menard Inc. shook off a proposed class action alleging its 11% rebate program cheats consumers by failing to consider their time and postage costs, as a Wisconsin federal court rejected a plaintiff’s fraud claims and said he suffered no monetary loss.
The term “rebate” incorporates the consumers’ costs associated with a mail-in program, Judge Brett H. Ludwig of the U.S. District Court for the Eastern District of Wisconsin said.
