Medtronic Failed SynchroMed Infusion Pump Suit Advances

Medtronic Inc. and related companies must keep defending against a man’s suit alleging he suffered withdrawal caused by a flawed SynchroMed II medication pump and had to have the device replaced, after a West Virginia federal court ruled he adequately stated non-preempted claims.

John D. Brumfield alleged manufacturing defect and warranty claims under state law that “parallel” Medtronic’s obligations under federal medical device law, the U.S. District Court for the Southern District of West Virginia said Thursday.
