A Maryland healthcare records provider can’t charge patients for obtaining medical records if no records were produced in its search, the state’s high court ruled.

Patient Janice Hollabaugh had standing to sue MRO Corp.—a company that contracted with her healthcare provider— and shouldn’t have been charged under the state’s Confidentiality of Medical Records Act, because the company charged her a preparation fee for her medical record request without retrieving her records, according to an opinion Thursday by Chief Justice Matthew J.
