Medical Marijuana Discrimination Case Goes Ahead in Pennsylvania

Cleveland Cliffs Steel LLC must face a suit alleging the company discriminated against a man over his prescribed use of medical marijuana, a Pennsylvania federal court ruled.

John DellaVecchio sued the company after it rescinded its offer of a co-op Associate Engineer position following his positive drug test result. DellaVecchio claimed he was a lawful possessor and user under the Pennsylvania Medical Marijuana Act.

Cleveland Cliffs moved the US District Court for the Eastern District of Pennsylvania to dismiss the claims, contending that DellaVecchio wasn’t protected by the PMMA because his card had expired at the time he tested positive. ...
