McLane Foodservice Inc. Shakes Truck Driver Overtime Pay Suit

McLane Foodservice Inc., a subsidiary of Berkshire Hathaway Inc., shook a wage and hour suit brought by former truck drivers after a California federal judge found the workers were exempt from overtime pay rules.

The driver plaintiffs, Jordan Orozco Madero and Esteban Orosco, drove interstate routes and therefore are subject to an exemption that puts them under the Secretary of Transportation’s jurisdiction, so federal maximum hours provisions don’t apply to them, Judge Kenly Kiya Kato ruled Thursday.
