Minnesota’s Mayo Clinic failed to shake off a federal suit seeking damages for alleged malpractice that occurred in Wisconsin because the Wisconsin medical defendants weren’t essential to the case, a federal court said.
Neither Mayo Clinic Health System-Northwest Wisconsin Region Inc.—a Mayo subsidiary—nor James Walker were indispensable parties, the U.S. District Court for the District of Wisconsin said.
The subsidiary’s Wisconsin citizenship, moreover, may not be attributed to Mayo for purposes of destroying federal diversity jurisdiction, the court said.
