The Earthjustice attorneys who successfully challenged Maui County’s failure to get a water pollution permit all the way to the U.S. Supreme Court should be paid about $1 million in fees and costs, a federal magistrate judge recommended.
The attorneys can recover fees and costs incurred during the Clean Water Act case’s trip before the high court and before the U.S. District Court for the District of Hawaii on remand, Magistrate Judge Kenneth J. Mansfield said in a report and recommendation before the lower court.
