Massachusetts Hospital Beats Suit Over Google Info Disclosure

Massachusetts-based Sturdy Memorial Hospital Inc. defeated a proposed class action alleging it collected and disclosed the personal information of website visitors to Google LLC in violation of federal and state privacy laws.

Lead plaintiff Deborah Caine failed to show that Sturdy Memorial was liable for wiretapping violations under the Electronic Communications Privacy Act, Judge Allison Burroughs of the US District Court for the District of Massachusetts said Tuesday.

Her complaint didn’t plausibly allege that the hospital intercepted the communications for the purpose of committing a criminal or tortious act, a requirement for party liability under ECPA, she said.
