A Maryland couple can pursue a proposed class action against a healthcare insurer that denied coverage of egg thawing as part of an in vitro fertilization procedure, the state’s top court said.
Matthew and Jamie Skipper’s class claims in state court against CareFirst BlueChoice Inc. weren’t moot, even thought they received payment after a federal court dismissed their first proposed class action, the Maryland Supreme Court said Monday. A class action defendant can’t moot a case by paying off the representatives before they’ve had a reasonable chance to file it, Chief Justice Matthew Fader said for the majority.
