Mars Petcare Sees Claims Cut From Iams Dog Food False Ad Suit

Mars Petcare US Inc. must continue defending a false ad suit over its Iams grain-free dog food, but a Tennessee federal court dismissed, for now, claims for injunctive relief such as marketing changes.

Arnold Fishon and others lack standing for an injunction because they haven’t shown they plan to buy the product again, the U.S. District Court for the Middle District of Tennessee said Nov. 20.

Now aware that Iams Grain-Free Recipe is allegedly mislabeled, the plaintiffs make no allegations to support an inference that they will suffer harm in the future, a requisite for injunctive relief, the court said. ...
