The lower court failed to consider the effect of a class-action waiver signed by all members of the proposed classes before granting certification, Judge Pamela A. Harris of the US Court of Appeals for the Fourth Circuit said Friday.
That error affected the lower court’s whole certification order, she said, vacating the order and remanding the case for the lower court’s consideration of the waiver.
