Marriott Defeats Bid to Remand Proposed Wage and Hour Class Suit

Marriott International Inc. can fight in California federal court a worker’s proposed wage-and-hour class action after a judge ruled the hospitality company’s potential damage calculations were reasonable, and cleared the minimum amount in controversy threshold to stay there.

Under the Class Action Fairness Act, federal courts have jurisdiction over class actions where the amount in controversy exceeds $5 million. The calculations Marriott provided were sufficient to meet its evidentiary burden, defeating the plaintiff’s motion for remand, Judge Fernando L. Aenlle-Rocha, of the US District Court for the Central District of California, said.
