Marketing Company Wins Bid to Stop Class Status in TCPA Lawsuit

An insurance agent’s junk-call lawsuit against marketing company Advisors Ignite USA LLC will proceed on an individual basis rather than as a class action, a federal court ruled.

Plaintiff David Van Elzen, a serial filer of suits under the Telephone Consumer Protection Act, failed to show that common questions predominated over individual questions as to the standing of class members to bring their claims in federal court, Judge William C. Griesbach of the US District Court for the Eastern District of Wisconsin said Thursday.
