The prosecution of a man accused of possessing a weapon while in the US illegally was revived Wednesday when a federal appellate panel found the indictment against him didn’t violate his Second Amendment rights.
An opinion by US Court of Appeals for the Seventh Circuit Judge Michael Brennan reversed a district court’s decision to toss the indictment against Heriberto Carbajal-Flores and remanded the case for further proceedings.
