A woman failed to show any evidence to support her claims in a medical malpractice lawsuit against the doctor who performed knee surgery, and repeatedly ignored a district court’s orders, the Third Circuit court said Thursday in affirming summary judgment for the physician.
The district court granted the motion for summary judgment based on Anna D. Arias’ “failure to produce expert testimony or other evidence,” in her lawsuit against the doctor and the hospital where the operation took place. The US Court of Appeals for the Third Circuit affirmed, saying there wasn’t a dispute over any material fact.
