The maker of H2O GO! inflatable pools alleges that the branding of an electronic accessory and tech company infringes its trademark, according to a new complaint.
Bestway USA Inc says it is “the largest selling brand in the United States” for inflatable recreation products, and its H2O GO! products “maintain substantial goodwill” across the country. But according to its complaint, filed in the US District Court for the Southern District of New York, Merkury Innovations’ “H2GLO” mark infringes Bestway’s intellectual property by using an allegedly infringing mark on several glowing inflatables.
