Maker of Fingerprint Keepsakes Beats Biometric Privacy Lawsuit

Keepsake-jewelry maker Legacy Touch Inc. and Chicago-based Glueckert Funeral Home defeated a proposed class action alleging they collected the fingerprints of dead people in violation of the Illinois Biometric Information Privacy Act.

Lead plaintiff Lauren Weiner didn’t have standing to pursue BIPA claims because the next-of-kin of a decedent isn’t an “aggrieved person” under BIPA, Judge David W. Dugan of the US District Court for the Southern District of Illinois said Thursday.

Dugan also dismissed Weiner’s claims under common law and the Illinois consumer-protection statute, finding that she didn’t allege cognizable damages as require to adequately plead the claims.
