Maine Credit Reporting Law Partly Survives Preemption Challenge

Maine law prohibiting companies such as Experian, Equifax, and TransUnion from reporting certain types of debt is only partially preempted by the federal Fair Credit Reporting Act, a federal judge ruled.

The decision is a mixed result for Maine and the Consumer Data Industry Association, whose members include the credit reporting agencies. The US District Court for the District of Maine entered a declaratory judgment in part for CDIA and in part for the state Tuesday.

The court ruled after the US Court of Appeals for the First Circuit in 2022 vacated an earlier decision on the preemption question.
