Hair care product maker Madison Reed Inc. must face most claims in a proposed class suit alleging it deceptively portrayed coloring products as safe and gentle.
Whether consumers could be misled by the company’s marketing is a fact question that can’t be resolved on a dismissal motion, a New York federal court said.
Melissa Moore alleged she started researching home hair coloring products during the Covid-19 pandemic when salons were closed. She bought Madison Reed products based on marketing statements that they were “salon” quality and contained ingredients that were less harsh than those in other products.
