Macy’s Worker Individual, Representative PAGA Claims Arbitrable

Macy’s West Stores Inc. can make a California employee arbitrate her individual wage claims under the state’s Private Attorneys General Act as well as the one she filed on behalf of the state.

Yuriria Diaz and Macy’s were both wrong about the effect of the US Supreme Court’s June ruling in Viking River Cruises, Inc. v. Moriana on Diaz’s lawsuit, the US District Court for the Central District of California said Nov. 23.

PAGA allows aggrieved workers to seek civil penalties for wage and other labor law violations on behalf of themselves, other workers, or the state.
