Macy’s Must Wait to Contest Class Status in Sheet Deception Suit

Macy’s West Stores Inc. must wait to challenge class certification in a suit by California consumers who allege the retailer deceived them with inflated thread counts in certain sheets, the Sixth Circuit said.

Sara Hawes alleged she bought “Somerset” brand Chief Value Cotton sheets labeled with a supposed thread count of 900. But the sheets have an actual thread count of 249, making them of lower-than-advertised quality, she alleged.

According to Hawes, Macy’s misrepresented thread counts in the entire Chief Value Cotton range, a category of cotton-polyester blend sheets sold to Macy’s by former defendant AQ Textiles.
