Luxottica of America Inc., which runs LensCrafters, convinced a federal court that an eyewear consultant’s lawsuit alleging the underpayment of wages can’t involve classes of other plaintiffs.
Passion Gabourel failed to show that she should lead several classes in her suit because many of the individuals she seeks to represent are subject to arbitration agreements that bar participation in the suit, Judge Fred W. Slaughter of the US District Court for the Central District of California said in a Tuesday order that denied Gabourel’s motion for class certification.
