Loyola University of Chicago will face reinstated class action claims by students seeking a refund of tuition and fees following the shift to online learning in spring 2020 due to the Covid pandemic, after the Seventh Circuit found sufficient allegations of breach of contract.
The allegations aren’t barred by the state’s educational malpractice doctrine and shouldn’t have been dismissed, the US District Court for the Seventh Circuit said in a divided opinion written by Judge Candace Jackson-Akiwumi.
