Lowe’s Scores Early Win in Manual Worker’s Class Pay-Delay Case

Lowe’s Home Centers LLC has a valid state authorization to pay its manual workers every two weeks instead of weekly, dooming a would-be class pay-delay suit, a federal judge said.

The plaintiff argued that Lowe’s, which was formerly known as Lowe’s Home Centers Inc., violated a New York law mandating weekly pay for manual workers because the company’s biweekly-pay authorization was under its old name. But that argument is “incorrect,” so the home improvement store chain is entitled to summary judgment, the US District Court for the Eastern District of New York said.
