Love’s Travel Stops & County Stores Inc. can’t require a Black customer service manager to arbitrate his race discrimination claims, at least for now, a Pennsylvania federal judge ruled.
The parties must instead first exchange evidence on whether the former employee actually agreed to the arbitration pact the fueling station and convenience store chain says it sent to him and other workers, the US District Court for the Middle District of Pennsylvania said. Marvin Quinn’s affidavit stating he doesn’t recall signing an arbitration pact raised a dispute on the agreement’s existence, the court said.
