Louisiana Covid Order Clears Caregivers in Negligence Case

A Louisiana long-term care facility escaped a suit accusing it of committing malpractice in 2020, because a state law gave it immunity from liability for care provided during the Covid-19 pandemic, a state appeals court said.

Under the Louisiana Health Emergency Powers Act, a person suing for medical malpractice that occurred while a public health emergency declaration was in effect may not recover unless she proves gross negligence or willful misconduct, the Louisiana Court of Appeal, Fifth Circuit said.
