Louis Vuitton Lawyer Beats Arbitration Push, But Loses Bias Suit

LVMH Moët Hennessy Louis Vuitton can’t make an in-house lawyer who testified about sexual harassment before Congress arbitrate her job retaliation claims, but her allegations fell short under federal and New York law.

Andowah Newton was correct that the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act permitted her to opt out of arbitration, because the act took effect in March 2022 and the acts of retaliation alleged in the suit occurred after that date, the US District Court for the Southern District of New York said.
