Logan Paul’s sports drink company Prime Hydration LLC convinced a federal judge to dismiss most claims in a consumer’s proposed class action alleging the company deceptively markets one of its beverages as healthy despite containing dangerous PFAS chemicals.
Reasonable consumers wouldn’t be misled by phrases proclaiming Prime Hydration’s Grape Sports Drink helps “refresh, replenish, or refuel” and is a “perfect boost for every endeavor” because the statements are “too vague and general,” the US District Court for the Northern District of California said Monday. But the court allowed a claim for breach of implied warranty to proceed.
