An Illinois specialty food retailer lost its bid to have Lloyd’s of London underwriters insure it, in a class action by employees alleging it violated a state biometric privacy law, a split appellate court ruled Tuesday.
The underlying Illinois Biometric Privacy Act lawsuit alleged that Tony’s Finer Foods Enterprises Inc. illegally collected employee fingerprints without their consent, in a database maintained by Kronos, a timekeeping company.
