Livestock Antibiotic Opponents Found to Lack Standing to Sue FDA

The US Food and Drug Administration won dismissal of a lawsuit attempting to ban the use of certain antibiotics used to prevent disease in healthy livestock and poultry.

The nonprofit Alliance of Nurses for Healthy Environments, joined by other organizations, that sued the FDA, alleging the antibiotics posed a “grave threat to people’s health” lacked legal standing to bring the suit forward, the US District Court for the District of Maryland ruled Monday. The organizations filed their suit after the FDA denied a petition to withdraw approval for some antibiotics used to prevent disease in the livestock.
