A LivePerson Inc. investor came up short in alleging the messaging company misrepresented the prospects of its WildHealth subsidiary but can refile his claims, the Second Circuit ruled Tuesday.
The district court judge didn’t have Noam Damri’s new witness materials before him when he concluded that it would be futile for the shareholder to amend his complaint, the US Court of Appeals for the Second Circuit said in an unsigned, unpublished ruling.
