Medical-device maker LivaNova USA Inc. failed to protect the personal information of nearly 130,000 patients that was exposed in an October 2023 data breach, a proposed federal class action said.
Arthur Podroykin alleged that LivaNova breached its duties under common law, contract, the Federal Trade Commission Act, and HIPAA to implement reasonable data security measures, comply with industry standards, and provide timely and adequate notice of the breach.
