Federal laws that generally prohibit handgun sales to buyers over 18 and under 21 will remain enforceable while the US Department of Justice appeals to the Fourth Circuit.
Judge Robert E. Payne of the US District Court for the Eastern District of Virginia granted a stay of his May injunction against the laws on Wednesday at the request of the Bureau of Alcohol, Tobacco, Firearms and Explosives. Payne acknowledged that “this area of law is in flux” after the US Supreme Court’s 2022 decision in New York State Rifle & Pistol Association v. Bruen.
