License Up For Grabs as Judge Reverses Tribal Casino Rejection

A tribally-owned casino operator can try again for an Illinois casino license, after an appellate court on Friday reversed a lower court’s rejection that it couldn’t contest its license denial.

Waukegan Potawatomi Casino LLC’s complaint, alleging Waukegan, Ill. city officials failed to follow Illinois Gaming Act’s statutory requirements when they rejected the casino company’s license application, shouldn’t have been dismissed, Justice Raymond W. Mitchell wrote for a unanimous three-justice panel.

The decision reverses the circuit court decision and remanded it to that court for further proceedings.
