A proposed class of online contact lens buyers can move forward with their claims that Lens.com engaged in false advertising by charging 50% more than the advertised price at checkout.
Judge David S. Leibowitz of the US District Court for the Southern District of Florida said Lens.com hasn’t met its burden to show that no reasonable juror could find its “Taxes and Fees” charges deceptive. That determination “must be made by an actual jury,” he said in his Wednesday order, especially in light of the parties’ “conflicting interpretations of the exact same evidence.”
