Legal Malpractice Suit Over Contract Language Revived on Appeal

An attorney and his firm were unable to escape a legal malpractice lawsuit on Wednesday after a federal appeals court ruled a lower court incorrectly deemed the suit untimely.

The one-year statute of limitations on a malpractice claim didn’t begin tolling until April 2023 since that’s when Stacy Cales discovered the legal advice in question, making her September 2023 lawsuit timely, Judge Eric L. Clay said.
