Legal Malpractice Suit Over Contract Language Revived on Appeal

An attorney and his firm were unable to escape a legal malpractice lawsuit on Wednesday after a federal appeals court ruled a lower court incorrectly deemed the suit untimely.

The one-year statute of limitations on a malpractice claim didn’t begin tolling until April 2023 since that’s when Stacy Cales discovered the legal advice in question, making her September 2023 lawsuit timely, Judge Eric L. Clay said. The US Court of Appeals for the Sixth Circuit reversed a district court’s grant of summary judgment to Theisen & Brock LPA and its attorney Kristopher Justice and remanded the suit for further proceedings. ...
