A man who reached an agreement with the SEC to end a civil case and was ordered to pay $12.1 million can continue his legal malpractice claim against his former attorney.
Bettina Schein failed to convince Judge Cecilia M. Altonaga, of the US District Court for the Southern District of Florida, that the judge should end Joseph Cole Barleta’s suit alleging Schein misrepresented the effects of a consent decree she “urged” Barleta to sign. Altonaga denied Schein’s summary judgment motion on Monday.
