Sazerac Co. failed to convince a federal judge to sanction a lawyer who sued it in Illinois over labeling of Fireball Cinnamon bottles even though it doesn’t officially offer the targeted product in the state.
Spencer Sheehan filed the suit in bad faith because he knew that Fireball Cinnamon isn’t sold in Illinois, Sazerac said. But the US District Court for the Northern District of Illinois on Wednesday rejected Sazerac’s sanctions motion because the complaint wasn’t “entirely baseless” and Sheehan voluntarily dismissed the suit after the company sent him a letter.
